Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Duchenne Smile Coach ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Duchenne Smile Coach is an iOS application that uses Apple's Vision framework to provide real-time facial analysis and smile coaching. The App analyses smile components (eyes, mouth, and symmetry) to help users develop a genuine Duchenne Smile. All processing occurs on-device.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Account and Device

The App does not require account creation. Your data is stored locally on your device and, if enabled, in your personal iCloud account. You are responsible for maintaining the security of your device and Apple ID.

5. Free and Premium Tiers

5.1 Free Tier

The free version of the App includes:

• Up to 2 daily training sessions
• 3 rotating daily challenges
• Gallery access for the last 30 days
• 1 event for event preparation
• Banner advertisements

5.2 Premium Subscription

Premium unlocks additional features including unlimited sessions, all challenges, full gallery history, up to 5 events, share and export, iCloud Backup, ad-free experience, and full stats and analytics.

6. Subscriptions and Payments

6.1 Pricing

Premium is available as:

• Monthly — $4.99/month
• Yearly — $29.99/year
• Lifetime — $49.99 one-time purchase

6.2 Billing

All purchases are processed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

6.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. For refund requests, please contact Apple Support directly.

6.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will not affect active subscriptions until the next renewal period.

7. Acceptable Use

You agree to use the App only for its intended purpose of smile training and coaching. You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to extract or modify the App's source code
• Use the App for any unlawful purpose
• Redistribute, sublicense, or resell the App
• Remove or alter any proprietary notices or labels

8. Intellectual Property

The App, including its design, mascot characters, user interface, code, and all associated content, is protected by copyright, trademark, and other intellectual property laws. All rights are reserved. The mascot character and "Duchenne Smile Coach" name are trademarks of the developer.

Your use of the App is also governed by our Privacy Policy, which describes how we handle (and don't handle) your data. By using the App, you agree to our Privacy Policy.

11. Availability and Updates

We strive to keep the App available and functional but do not guarantee uninterrupted service. We may release updates to improve functionality, fix bugs, or add features. While we aim to maintain backward compatibility, some updates may require a minimum iOS version.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Smile scores or analysis results will be perfectly accurate
• Any defects in the App will be corrected

13. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the App.

14. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

17. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

18. Apple's Standard EULA

In addition to these Terms, your use of the App is subject to Apple's Standard End User License Agreement (EULA) for licensed applications, available at Apple's Standard EULA.
